TERMS OF SERVICE

1. Acceptance of Terms

By accessing or using d88.dev ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

2. Description of Service

d88.dev is an AI-powered website builder that creates full-featured websites from prompts. The Service includes:

  • AI-powered website generation from natural language descriptions
  • Complete website building and deployment capabilities
  • Project management and cloud storage for your websites
  • Export and import functionality for website projects
  • Subscription-based access with usage limits

3. Account Creation and Authentication

To use the Service, you must create an account using Google OAuth authentication. You are responsible for:

  • Maintaining the security of your account
  • All activities that occur under your account
  • Providing accurate and complete information
  • Notifying us immediately of any unauthorized use

4. Acceptable Use

You agree not to:

  • Use the Service for any illegal purpose or in violation of any laws
  • Transmit any malicious code, viruses, or harmful data
  • Attempt to gain unauthorized access to the Service or related systems
  • Interfere with or disrupt the Service or servers
  • Use automated systems to access the Service without permission
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Share your account credentials with others

5. Subscription Plans and Billing

The Service offers subscription plans (Free, Pro, Ultra, Custom) with different features and usage limits. By subscribing, you agree to:

  • Pay all fees associated with your subscription plan
  • Automatic renewal unless cancelled before the renewal date
  • Price changes with 30 days notice
  • No refunds for partial subscription periods unless required by law

Cancellation Policy: You may cancel your subscription at any time through your account settings. Cancellation prevents future renewals but does not provide a refund for the current billing period. You will continue to have access to your paid features until the end of your current billing cycle. At the end of the billing cycle, your account will revert to the Free tier (if applicable) or be suspended.

6. Usage Limits

The Service uses daily usage limits to manage AI feature usage:

  • Daily Caps: Usage resets daily at 12:00 AM Eastern Time.
  • Free Plan: Limited daily usage with a maximum number of usage days per month.
  • Usage is based on internal LLM costs per request.
  • Usage allowances are non-transferable and non-refundable.

7. AI-Generated Content

The Service uses artificial intelligence to generate websites. You acknowledge that:

  • AI-generated websites and code may contain errors or inaccuracies
  • You are responsible for reviewing and validating all AI-generated websites
  • We make no warranties about the accuracy, completeness, or suitability of AI-generated websites
  • AI-generated websites are provided "as-is" without guarantees
  • You should not rely solely on AI-generated websites for critical business needs without review
  • The AI models we use are private and do not expose your sensitive data to training - your data is not used to train or improve the AI models

8. Intellectual Property

Your Content: You retain all ownership rights to the websites and content you create using the Service. You grant us a limited license to store, process, and display your content solely for the purpose of providing the Service.

Service Content: The Service, including its design, features, and functionality, is owned by us and protected by intellectual property laws. You may not copy, modify, or create derivative works without our written permission.

9. Data Storage and Backup

We provide cloud storage for your website projects. However:

  • You are responsible for maintaining backups of your important websites
  • We are not liable for data loss due to technical failures, user error, or account deletion
  • We reserve the right to delete accounts that have been inactive for extended periods
  • Data may be stored on third-party infrastructure (Supabase) subject to their terms

10. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be unavailable due to:

  • Scheduled maintenance
  • Technical issues or failures
  • Third-party service outages
  • Force majeure events

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with or without notice.

11. Termination

We may terminate or suspend your account immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

You may terminate your account at any time by deleting it through your account settings. Upon termination:

  • Your access to the Service will cease
  • Your websites and data may be deleted after a reasonable retention period
  • You are responsible for exporting your data before termination
  • No refunds will be provided for unused subscription time

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY.

13. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of your use of the Service, violation of these Terms, or infringement of any rights of another.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Service. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Ontario, Canada.
